Third DUI Offense

If you are facing your third DUI conviction, the penalties will be determined by the number of prior DUI offenses and your Blood Alcohol Content (BAC).

If you are convicted of a third DUI offense in the state of Pennsylvania, you could experience the following:

  • If your BAC is between .08 and .099, your penalties will include:
    • 10 days mandatory jail time, and up to 2 years in prison
    • A fine between $500 – $5,000
    • 12 month license suspension
    • 1 year ignition interlock prior to getting your license reinstated
  • If your BAC is between .10 and .159, your penalties will include:
    • 90 days mandatory prison time, and up to 5 years in jail
    • A fine between $1,500 – $10,000
    • 18 months license suspension
    • 1 year ignition interlock prior to getting your license reinstated
  • If your BAC is .16 or higher, your penalties will include:
    • 1 year mandatory jail time, and up to 5 years in prison
    • A fine of at least $2,500 – $10,000
    • 18 months license suspension
    • Ignition interlock required prior to getting your license reinstated
